Here I set the stage for developing a Kantian account of punishment attuned to social and economic injustice and to the need for prison reform. I argue that we cannot appreciate Kant's own discussion of punishment unless we read it in light of the theory of justice of which it is a part and the fundamental commitments of that theory to freedom, autonomy and equality. As important, we cannot properly evaluate Kant's advocacy of the law of retribution unless we recognize (...) his theory of justice as an ideal theory. Once we understand both Kant's larger account of justice and its relationship to his less basic commitments, we discover grounds to accept that larger theory, but reject components like the law of retribution with their basis in empirical conclusions we may not share with Kant. We also open the way to develop an account of punishment responsive to social circumstances. (shrink)

To isolate, analyze and explain their most basic commitments, theories of justice typically idealize. They assume for theoretical purposes, for example, that human beings possess far greater knowledge than they do, or that society's members strictly comply with just laws. Yet because it falsifies, idealization undermines the practical applicability of an ideal theory's principles. ;Although ideal theories are unsatisfactory as they stand, their fundamental principles may be invaluable in addressing our problems of justice. From such basic principles we may derive (...) intermediate ones that bridge the gap between ideal world and real, and allow us to determine what ideal theory demands in actual circumstances. ;Going beyond others who recognize the need, but themselves offer only ideal theories, I develop a set of these intermediate principles. I examine Kant's theory of justice as a paradigm, and identify problems it cannot address because they have their source in non-ideal features, including limited knowledge, imperfect will and preexisting social injustice. I then appeal to a modified version of the perspective of the ideal citizen that Kant employs in the Rechtslehre. This modified perspective enables us to articulate principles that give effect to Kant's universal law of justice and categorical imperative in non-ideal circumstances. Illustrating its use in addressing issues such as prison reform and exclusionary zoning, I argue that augmented ideal theory can play a crucial role in our pursuit of social justice. (shrink)

Despite the extreme violence and severe overcrowding that plague U.S. prisons, prison reform is nearly a non-issue in this country. Immanuel Kant's Metaphysics of Morals may first appear an unlikely place to seek support for a more critical view of prison conditions and popular attitudes toward them. But by appeal to the doctrines of right and virtue, we can discover substantial Kantian grounds to support reform efforts.On Kantian bases I thus develop two principles, the first a principle of justice and (...) the second one of civic virtue. Together these standards, intermediate between the more general principles of Kant's moral theory and our concrete practical problems, can guide us in addressing interrelated issues of prison conditions and crime deterrence and in evaluating our own tendency to view convicts as somehow outside the ranks of humanity. While the principles of improvement and of civic respect cannot provide final answers to relevant reform issues, they can carry us a significant distance in identifying and understanding our weight moral responsibilities in this realm. Obwohl die US-Gefängnisse mit starker Überfüllung und extremer Gewalt zu kämpfen haben, ist eine Reform des Gefängniswesens in den Vereinigten Staaten nahezu kein Thema. Kants "Metaphysik der Sitten" mag zunächst nicht als ein Ort erscheinen, an dem man für eine Kritik an den Bedingungen in den Gefängnissen und an der allgemeinen Einstellung in der Bevölkerung dazu irgendeine Hilfe sucht. Bei näherem Hinschauen können wir jedoch in Kants Rechts- und Tugendlehre wesentliche Gesichtspunkte entdecken, die die Reformversuche unterstützen. In meinem Beitrag entwickle ich auf Kantischer Grundlage zwei Prinzipien, ein Prinzip der Gerechtigkeit und ein Prinzip bürgerlicher Tugend, Standards, die irgendwo zwischen den allgemeinen Prinzipien von Kants Moraltheorie und unseren konkreten praktischen Problemen stehen. Zusammen können uns diese beiden Standards eine Anleitung dafür geben, wie die miteinander verwobenen Themen a) der Bedingungen in den Gefängnissen und b) der Verbrechensabschreckung anzugehen sind und wie wir unsere eigene Neigung zu beurteilen haben, verurteilte Strafgefangene als mehr oder weniger außerhalb der Menschheit stehend anzusehen. Obwohl das Prinzip der Besserung und das der bürgerlichen Achtung, wie ich sie nenne, auf die einschlägigen Reformprobleme keine endgültigen Antworten geben können, können sie uns doch bei der Erkenntnis und beim Verstehen unserer nicht geringen moralischen Verantwortung in diesem Bereich einen großen Schritt weiterbringen. Social psychological research on youth intergroup relations has primarily examined interactions between dichotomous groups through cross-sectional and self-report measures in single contexts. Such traditional approaches, however, are not adept to capturing the dynamic nature of intergroup relations for youth growing up in multicultural societies. In this chapter, we briefly review the existing literature on youth interethnic interactions. We next discuss some theoretical and methodological limitations of this research. We then review the handful of studies focused on youths’ behaviour in diverse (...) contexts, as well as emerging research examining youth and behavioural trajectories when moving beyond the dichotomies of Black and White. We end the chapter by proposing a new research agenda which brings youth into context and extends theoretical boundaries by drawing on a range of innovative methods. We argue this broader approach is needed if we are to truly understand the implications of growing ethnic diversity for youth. (shrink)

This paper explores the relationship between religious denomination and individual attitudes to Corporate Social Responsibility (CSR) within the context of a large sample of over 17,000 individuals drawn from 20 countries. We address two general questions: do members of religious denominations have different attitudes concerning CSR than people of no denomination? And: do members of different religions have different attitudes to CSR that conform to general priors about the teachings of different religions? Our evidence suggests that, broadly, religious individuals do (...) not prioritise the responsibilities of the firm differently, but do tend to hold broader conceptions of the social responsibilities of businesses than non-religious individuals. However, we show that this neither true for all religious groups, nor for all areas of CSR. (shrink)

WilliamsIt is universally acknowledged by scholars of Nietzsche’s work that will to power is one of the most important notions in Nietzsche’s writings, but strangely, like the other “central” notions of eternal recurrence and the Übermensch, there are relatively few aphorisms in either the published or unpublished material that include the term. In the case of will to (...) power, however, Nietzsche promises in a footnote in On the Genealogy of Morals to discuss and explore the notion of will to power in a book entitled The Will to Power. 1 Giorgio Colli and Mazzino Montinari, among others, have argued persuasively that Nietzsche abandoned this project. 2 Nevertheless, the phrase “will to power” remains the most notorious feature of Nietzsche’s philosophy, probably due to its unfortunate and mistaken connections with the Third Reich. As Walter Kaufmann notes, the notion of will to power did not “spring fully formed from Nietzsche’s brow like Pallas Athena.” 3 This was an idea that evolved over time. This paper examines both the published and his unpublished writings (the Nachlass) to gain a better understanding of how this important phrase developed.The Nachlass can be divided roughly into three different kinds of work. 4 The first kind is comprised of the works Nietzsche was editing right before his collapse. These works are Ecce Homo, Nietzsche Contra Wagner, and The Antichrist, and they were so polished that we can safely take them as [End Page 447] equal in status to the works that Nietzsche had already published or, like Twilight of the Idols, were being published at the time of his collapse. The second kind are Nietzsche’s early, finished pieces that were never published, the so-called Schriften, primarily his lectures and writings while he was employed at Basel. These pieces are presumably complete and polished, although Nietzsche chose not to publish them, but they do not affect this inquiry, since will to power was a relatively late concept for Nietzsche.The third kind of work consists of Nietzsche’s notes, which vary from sentence fragments or single sentences to sketchy outlines of various projects to several long paragraphs in essay form. Nietzsche’s notebooks looked like anyone’s notebook, with passages lined out, words jotted in the margins, and overwriting. Some of the entries in the Nachlass can be found with only minor revisions in the books Nietzsche had published, and since he painstakingly recopied his books in his neatest handwriting right before he sent them to his editor, these strikingly similar entries are most probably the penultimate copy drafts of the published aphorisms.The writings that did not find their way into publication in any form are problematic. Are they rough drafts of some future work which Nietzsche was unable to complete due to his illness? If so, some of these controversial notes would have been waiting for years. Are they ideas that Nietzsche entertained but ultimately rejected? If so, we should not place them on par with the ideas in his published works. Even if we consider these notes rough drafts of future works, it remains unclear whether we should consider what is written in these notes to be as indicative of what Nietzsche thought as the works he authorized for publication. Sometimes what is written in the unpublished notes on a particular topic is very different from what is written on that topic in the published works. Bernd Magnus made this kind of case against the Nachlass notes concerning eternal recurrence, 5 and I want to make a similar claim about the notes concerning will to power. Reviewing the Nachlass notes in conjunction with the published aphorisms will give us a better understanding of how the published and unpublished notes differ.The term “will to power” (Wille zur Macht) first appeared in publication in Thus Spoke Zarathustra. 6 In the aphorism “On 1001 Goals” Nietzsche describes a people’s tablets of good and bad as the voice of its will to power. Despite its invasive nature, specific consent for general anaesthesia is rarely sought—rather consent processes for associated procedures include explanation of risk/benefits. In adult intensive care, because no one can consent to treatments provided to incapacitated adults, standardised consent processes have not developed. In paediatric intensive care, despite the ready availability of those who can provide consent, no tradition of seeking it exists, arguably due to the specialty’s evolution from anaesthesia and adult intensive care. With the current Montgomery-related focus on consent, (...) this seems untenable. We undertook a qualitative study in a specialist children’s hospital colocated paediatric/neonatal intensive care (same medical team) in which parental acceptance of admission and entailed procedures is considered implied by virtue of that admission. Semistructured interviews were carried out with both staff and parents to investigate their views about consent, the current system and a proposedblanket consent system, in which parents actively consent at admission to routine procedures. Divergent views emerged: staff were worried that requiring consent at admission might prove a further emotional burden, whereas parents found providing consent a way of coping, feeling empowered and maintaining control. Inconsistencies were found in the way consent is obtained for your routine procedures. Practice does seem inconsistent with contemporary consent standards for medical intervention. Our findings support the introduction of a blanket consent system at admission together with ongoing bedside dialogue to ensure continuing consent. Both parents and staff expressed concern about avoiding possible harmful delays to children due to parental emotional overload and language difficulties. (shrink)

Stanovich & West continue a history of norm-setting that began with deference to reasonable people's opinions, followed by adherence to probability theorems. They return to deference to reasonable people, with aptitude test performance substituting for reasonableness. This allows them to select independently among competing theories, but defines reasoning circularly in terms of aptitude, while aptitude is measured using reasoning.

In the remarks that follow I concentrate on Lorenzo Simpson's two books, Technology, Time and the Conversations of Modernity (cited as TTC) and The Unfinished Project: Toward a Postmetaphysical Humanism (cited as UP). Common to both works — what unites them, I believe — is a philosophical orientation that has been deeply influenced by Gadamerian hermeneutics. I begin with a discussion of UP.

Somalia, Haiti, Bosnia, and Kosovo. All are examples where humanitarian intervention has been called into action. This timely and important new volume explores the legal and moral issues which emerge when a state uses military force in order to protect innocent people from violence perpetrated or permitted by the government of that state. Humanitarian intervention can be seen as a moral duty to protect but it is also subject to misuse as a front for imperialism without regard to international law. (...) In Humanitarian Intervention, the contributors explore the many questions surrounding the issue. Is humanitarian intervention permitted by international law? If not, is it nevertheless morally permissible or morally required? BackgroundThe potential contribution of community engagement to addressing ethical challenges for international biomedical research is well described, but there is relatively little documented experience of community engagement to inform its development in practice. This paper draws on experiences around community engagement and informed consent during a genetic cohort study in Kenya to contribute to understanding the strengths and challenges of community engagement in supporting ethical research practice, focusing on issues of communication, the role of field workers in 'doing ethics' on (...) the ground and the challenges of community consultation.MethodsThe findings are based on action research methods, including analysis of community engagement documentation and the observations of the authors closely involved in their development and implementation. Qualitative and quantitative content analysis has been used for documentation of staff meetings and trainings, a meeting with 24 community leaders, and 40 large public and 70 small community group meetings. Meeting minutes from a purposive sample of six community representative groups have been analysed using a thematic framework approach.ResultsField workers described challenges around misunderstandings about research, perceived pressure for recruitment and challenges in explaining the study. During consultation, leaders expressed support for the study and screening for sickle cell disease. In community meetings, there was a common interpretation of research as medical care. Concerns centred on unfamiliar procedures. After explanations of study procedures to leaders and community members, few questions were asked about export of samples or the archiving of samples for future research.ConclusionsCommunity engagement enabled researchers to take account of staff and community opinions and issues during the study and adapt messages and methods to address emerging ethical challenges. Field workers conducting informed consent faced complex issues and their understanding, attitudes and communication skills were key influences on ethical practice. Community consultation was a challenging concept to put into practice, illustrating the complexity of assessing information needs and levels of deliberation that are appropriate to a given study. This paper examines the creation of independent agencies within the EU, such as the European Environment Agency and the European Central Bank. Majone and others have argued the case for European regulatory agencies. Such agencies can provide for continuity, expertise, accountability and effective authority – in short, an institutionalisation of responsibility. Against this optimism, I argue that a dilemma of institutional design naturally arises from the agencies’ situation in the EU. On the one side, we risk creating powerful agencies that (...) institutionalise monomania– that is, agencies that single-mindedly and all-too-effectively pursue narrow agendas, inadequately checked by other bodies. On the other, we are also likely to encounter relatively impotent agencies which institutionalise schizophrenia– that is, agencies that must scout around for audience and support, and hence are unable to act effectively. This essay offers a critical examination of Neil Ormerod’s treatment of the debate between Lonergan and Gilson on the question of being. Although this debate concerns a highly technical issue of metaphysics and epistemology, it remains germane and relevant, especially within the field of Christian thought. In Ormerod’s careful and for the most part generous examination of this debate, he argues that being for Gilson is perceived through the senses, whereas for Lonergan being is intended in the questions that arise (...) from the relevant sense data. Where Gilson’s philosophy gives priority to the metaphysics of being, Lonergan gives priority to epistemology and cognitional theory. In arguing for the superiority of Lonergan’s approach to the question of being, Ormerod relies on a fundamental misunderstanding of Gilson’s metaphysics. By appeal to the more recent work of Kenneth Schmitz, this essay proposes a proper understanding of Gilson’s metaphysics as a basis for a more conciliatory relationship between these two giants in modern Christian philosophy who too often are pitted against one another.
